In 1961, Edward Mead and two codefendants, Henderson and Shott, were convicted of two counts of burglary. Thereafter, the three filed a notice of appeal and a petition for leave to appeal in forma pauperis. Exercising its discretionary power under Alaskas then applicable procedural rule, the superior court denied the petition to proceed in forma pauperis, and the appeal was not prosecuted. In 1969, Mead filed an application for post-conviction relief. The superior court denied Meads application on condition that he request this court to grant him an extension of time in which to file a notice of appeal from the 1961 judgment of conviction. We granted the motion and Meads appeal followed.
